Terms & Conditions

PLEASE READ CAREFULLY. By participating, you agree to the following rules governing the Super Star® Rewards Program, including any changes that are made. The date above indicates the date of the most recent change in the Terms & Conditions.

1. Overview of the Super Star® Rewards Program

Super Star® Rewards Program (the "Program") is a program sponsored by Carl’s Jr. Restaurants LLC and Hardee’s Restaurants LLC(collectively, "Sponsor") through which users of the Super Star® Rewards mobile application (“SSR”) can earn points by checking in when visiting Carl’s Jr. or Hardee’s restaurant locations, or through other methods as may be added from time to time. Individuals may redeem their points for Carl’s Jr. or Hardee’s product coupons as more fully described below.

2. Timing

The Program begins on May 28, 2013 at 12:00 a.m. Eastern Time ("ET") and ends on December 31, 2014 at 11:59 p.m. ET or while coupon supplies last (the "Program Period"). Sponsor’s computer is the official time-keeping device for the Program. Notwithstanding the foregoing, Sponsor reserves the right to shorten, extend, suspend, modify, or cancel the Program, at its discretion, at any time.

3. Eligibility

The Program is open to legal residents of the fifty (50) United States and the District of Columbia (excluding states without any Carl’s Jr. or Hardee’s restaurants) who are at least eighteen (18) years old at the time of entry. Void in states without any Carl’s Jr. or Hardee’s restaurants and where prohibited by law. The Program is provided to individuals only. Corporations, associations or groups may not participate.
The Program is open only to individuals who own devices with the below-listed operating systems with GPS functionality enabled:

  • Apple OS Versions: iOS 6.0, 6.1, 6.1.4
  • Android OS Versions: Android 2.3.3; Android 3.0; Android 3.1; Android 3.2; Android 4.0; Android 4.0.3

4. Eligibility for Individuals Related to Sponsor

Employees, officers, and representatives of Carl’s Jr. Restaurants LLC, Hardee’s Restaurants LLC, Apple, Inc., Google Inc., and 72andSunny, L.P. and each of their respective parents, affiliates, subsidiaries, advertising and promotion agencies and suppliers involved in the Program (the “Program Participants”) may participate in the Program under the following conditions: 1) they must enroll for the Program using their company email address if one was provided to them; and 2) the total number of points an employee or representative can redeem in the Program Period is capped at one thousand (1000) points per thirty (30) day period. Violation of this policy may result in disqualification from the Program and is grounds for disciplinary action.
The immediate family members (mother, father, sister, brother, husband, wife, daughter, son, step-father, step-mother, step-daughter, step-son, step brother, step-sister, half-brother, half-sister) of employees, officers and representatives of the Program Participants and/or those living in the same household of each may participate under the condition that the total number of points that each such related-individual can redeem in the Program Period is capped at one thousand (1000) points per thirty (30) day period.

5. Program Enrollment

For Device utilizing iPhone OS 6.0 or Higher
In order to participate in the Program, you must first download SSR to your mobile device. There are 2 ways to obtain SSR: (a) During the Program Period, go to www.superstarrewards.com and click on the link to the iTunes store to download SSR; or (b) Access the iTunes store directly from your device and download SSR. Users will be required to register by entering information including the following fields: First and Last Name, Email Address, SSR Password, City of Residence, Date of Birth and Mobile Phone Number (optional).

For Device using Android OS 2.3.3 or Higher
In order to participate in the Program, you must first download SSR to your mobile device. There are 2 ways to obtain the Application: (a) During the Program Period, go to www.superstarrewards.com and click on the link to the Google Play Store to download SSR; or (b) Access the Google Play Store directly from your device and download SSR. Users will be required to register by entering information including the following fields: First and Last Name, Email Address, SSR Password, City of Residence, Date of Birth and Mobile Phone Number (optional).

The number of points collected by each user will be recorded and tracked in the user’s account.

Only one (1) registration is permitted per device. In the event of a dispute as to any registration, the authorized account holder of the device used to register will be deemed to be the registrant or player. The “authorized account holder” is the natural person assigned a unique device ID to their mobile device. When a user redeems points, he or she will need to provide the email address linked to his or her account. If a user does not provide an email address when required, or if his or her email address is deemed to be invalid, Sponsor reserves the right not to redeem the reward, to invalidate the redemption, and/or to lock the user’s, in its sole discretion.

6. How to Earn Points

During the Program Period, once you have downloaded SSR to your device, open SSR. The first time you open SSR you will be directed to an instructions screen with specific details on how the Program works (on subsequent restaurant check-ins you will not be presented with these instructions). Once you open SSR, the application will use your device’s GPS functionality to help you locate the nearest Carl’s Jr. or Hardee’s restaurant. You will be prompted to visit Carl’s Jr. or Hardee’s restaurants during the Program Period in order to earn points. During each restaurant visit, you will verify your location using your device’s GPS system. You must check-in using SSR during your restaurant visit in order to earn points. Upon check-in, your account will be credited with the points you have earned for your check-in. Users may not check-in more than two (2) times per twenty-four (24) hour period, and are limited to one (1) check-in between 5:00 a.m. and 2:00 p.m. and one (1) check-in between 2:00 p.m. and 5:00 a.m. in your local time zone. Users cannot check-in more than once every two (2) hour period. No purchase is necessary to participate.

Sponsor will offer the opportunity for bonus points at various times during the Program Period (amount, days and times of bonus entries shall be determined by Sponsor in its sole discretion and are subject to change at any time during the Program).
Some methods of earning points and bonus points may not be available during the entire Program Period. Sponsor reserves the right to change, add, or remove the methods by which you can earn points and bonus points.

Sponsor reserves the right to change the number of points awarded for check-ins and to change the number of bonus points awarded for at any time during the Program.

It is fraudulent for any individual or company, association, or group to direct, encourage, or allow individuals to use a single account for the purpose of accumulating points for combined use. Any attempt to combine or transfer codes or points will result in the user’s disqualification from the Program and forfeiture of all points in the user’s account. Sponsor reserves the right to take any action it deems appropriate in its sole discretion in the event that it believes (in its sole discretion) that any user has violated any of these provisions.

All points earned will be subject to verification by an independent judging organization whose decisions on the outcome are in its sole discretion and are final and binding. Points are void if (a) not obtained in accordance with these Terms & Conditions and through legitimate channels; (b) obtained via use of robotic, automatic, programmed or like methods; (c) obtained via hardware or software tampering, alterations or network interference; or (d) obtained as a result of fraudulent or unsportsmanlike activity or technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software related to the Program. Sponsor reserves the right to rescind points credited to an account which it determines, it its sole discretion, that such points are void.

If a user believes that points were not properly accrued to his/her account, the user must notify Sponsor within ten (10) days of the date of the relevant check-in or bonus point activity at: support@superstarrewards.com.

In its sole discretion, Sponsor reserves the right to reverse points previously credited to a user’s account, if it determines, in its sole discretion, that the points were not obtained in accordance with these Terms & Conditions and through legitimate channels. Sponsor’s decisions regarding the awarding of points are final and binding. In addition, all points are subject to verification by Sponsor or its delegate and all decisions by Sponsor with regard to the outcome of such verification shall be final and binding.

Users may collect points during the Program Period, as it may be extended or otherwise modified by Sponsor.

7. Point Redemption

Users may redeem their points for Carl’s Jr. and Hardee’s coupons (“Rewards”) listed on the Rewards List Page in SSR. SSR will list the corresponding point values required to be redeemed for each item.

Each user must comply with any individual Rewards limitations indicated on SSR. Periodically throughout the Program Period, Sponsor will modify the list of Rewards available for point redemption. Sponsor reserves the right to modify the point value(s) for Rewards, at any time and for any reason, during the Program Period. All redemptions are subject to these Terms & Conditions and all limitations and/or requirements specified in SSR.

Terms and conditions of coupons apply. COUPONS HAVE NO CASH VALUE. No cash or other substitution, assignment or transfer of any Rewards permitted, except by Sponsor, who reserves the right to substitute a Reward with another Reward of comparable or greater value. Users are responsible for all federal, state, and local taxes and fees associated with point and Rewards receipt and/or use. Rewards are awarded "as is" with no warranty or guarantee, either express or implied offered by Sponsor.

To spend/redeem points, navigate through the items listed in SSR. Users may choose any Reward still available for which he or she has accumulated sufficient points for redemption, then he or she must click on the image corresponding to the item and follow the links and instructions to complete the redemption process.
Each user is responsible for ensuring the accuracy of his/her account and is encouraged to check his/her account regularly. Changes to an account or account information may only be made by the user to whom the account belongs. Sponsor is not responsible for any incorrect or inaccurate information supplied by any user participating in the Program.

All point redemptions for Rewards are final. No refunds or exchanges are permitted.

Users may redeem points in the manner set forth above until the end of the Program Period, unless the Program Period is extended or otherwise modified by Sponsor. In the event that Sponsor elects, in its sole discretion, to operate a new phase of the Program following the end of the Program Period, Sponsor reserves the right to carry over all points collected during the previous phase of the Program into the current phase. Notwithstanding the foregoing, Sponsor reserves the right to expire points from previous phases upon reasonable notice to users.

8. Forfeiture

At the end of the Program Period, a user will forfeit any points remaining in his/her account, without compensation (unless the Program Period is extended by Sponsor).

9. Modifications and Termination of the Program

Sponsor reserves the right to modify any of the Terms & Conditions set forth herein, including, but not limited to, the duration of the Program Period, methods by which users may collect points, the eligible products to be purchased, the number of points associated with the purchase of eligible products or other activities, the number of points that may be redeemed through the Program, and any of the options made available to users with respect to their accounts, at any time, with notice, even though these changes may affect a user’s ability to accrue or use his/her points. Sponsor reserves the right to terminate or temporarily suspend the Program at any time, for any reason, with notice, even though termination may affect a user’s ability to accrue or use his/her points. In the event of an early termination, users will have thirty (30) days from the date on which the Program termination is announced to redeem their points. If the Program expires as scheduled, users will have until the end of the Program Period to redeem their points.

A user’s continued participation in the Program constitutes the user’s acceptance of any changes to these Terms & Conditions. Users are responsible for remaining knowledgeable of any changes that Sponsor may make to these Terms & Conditions. The most current version of these Terms & Conditions, which will indicate the date they were last updated, will be available in SSR and will supersede all previous versions of these Terms & Conditions.

10. General Terms and Conditions

Points have no cash value and are only redeemable for offered Rewards via the Program.
All notices regarding the Program will be provided through SSR and/or such other means adopted by Sponsor from time to time at its discretion. Users are responsible for reviewing SSR for any notices on a regular basis.

To learn how the personal information collected in connection with the Program may be used, participants should read the Privacy Policy for SSR which is available at www.superstarrewards.com/privacypolicy. The terms of the SSR Privacy Policy are incorporated herein by reference.

Sponsor reserves the right to discontinue the participation privileges of any user who engages in any fraudulent activity or uses the Program in a manner inconsistent with these Terms & Conditions or with any federal, state or local, laws, statutes or ordinances. Discontinued participation privileges may result in the loss of all accumulated points. In addition, Sponsor shall have the right to take appropriate administrative and/or legal action, including criminal prosecution, as it deems necessary in its sole discretion.

Points are not the property of a user and may be revoked at any time by Sponsor as set forth herein. Points may not be transferred or assigned. All questions or disputes regarding eligibility for the Program, collecting or redemption of points, or user’s compliance with these Terms & Conditions will be resolved by the Sponsor in its sole discretion.

Users are responsible for the payment of all taxes which may result from the points or Reward(s) received as part of the Program.

11. Limitation of Liability

Carl’s Jr. Restaurants LLC and Hardee’s Restaurants LLC, Apple, Inc., Google Inc., 72andSunny, L.P. and each of their respective parents, subsidiaries, affiliates, related companies, advertising and promotion agencies and suppliers and each of its and their respective officers, directors, employees, and agents (collectively the “Released Parties”) are not responsible for incorrect or inaccurate transcription of information, for problems related to any of the equipment or programming associated with the Program or utilized by users, for any human error, for any interruption, deletion, omission, defect, or line failure of any telephone network, cellular network, or electronic transmission, for problems relating to computer equipment, software, inability to access SSR or online service, or for any other technical or non-technical error or malfunction. UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL ANY OF THE RELEASED PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE PROGRAM OR REWARDS OFFERED THROUGH THE PROGRAM, EVEN IF ANY OR ALL OF THE FOREGOING OR ANY OF THEIR AUTHORIZED REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF THE SPONSOR IMPROPERLY DENIES A USER ANY POINTS, LIABILITY WILL BE LIMITED TO THE EQUIVALENT NUMBER OF POINTS. BY PARTICIPATING IN THE PROGRAM, USERS WAIVE ANY AND ALL RIGHTS TO BRING ANY CLAIM OR ACTION RELATED TO SUCH MATTERS IN ANY FORUM BEYOND ONE YEAR AFTER THE FIRST OCCURRENCE OF THE KIND OF ACT, EVENT, CONDITION OR OMISSION UPON WHICH THE CLAIM OR ACTION IS BASED.

USERS ACKNOWLEDGE THAT REWARDS ARE AWARDED AS-IS. RELEASED PARTIES MAKE NO WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, LEGAL COMPLIANCE WITH RESPECT TO APPLICABLE LAWS OR NONINFRINGEMENT AS REGARDS TO THE REWARDS OR ANY COMPONENTS THEREOF. VOID WHERE PROHIBITED, AS SOME JURISDICTIONS MAY NOT ALLOW LIMITATIONS OF EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES.

Users further herby understand and agree that all rights under Section 1542 of the Civil Code of California and any similar law of any state or territory of the United States are hereby expressly waived. Section 1542 reads as follows:

1542. CERTAIN CLAIMS NOT AFFECTED BY GENERAL RELEASE. A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR.

12. Disputes

As a condition of participating in this Program, each user agrees that: (i) any and all disputes, claims, and causes of action arising out of or connected with the Program or any Rewards awarded shall be resolved individually, without resort to any form of class action, and exclusively in the State of California, County of Orange; (ii) any and all claims, judgments, and awards shall be limited to actual, direct out-of-pocket costs incurred, but in no event attorneys' fees; and (iii) under no circumstances will users be permitted to obtain awards for and user hereby waives all rights to claim punitive, incidental, indirect, special and consequential damages and any other damages, other than for actual, direct out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Terms & Conditions, or the rights and obligations of the user and Sponsor in connection with the Program, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.

13. Entire Agreement

These Terms & Conditions constitute the entire agreement between Program participants and Sponsor pertaining to the subject matter hereof and supersede all prior or other arrangements, understandings, negotiations and discussions, whether oral or written. No waiver of any of the provisions of these Terms & Conditions shall be deemed or shall constitute a waiver of any other provisions hereof (whether or not similar), nor shall waiver constitute a continuing waiver unless otherwise expressly provided. If any provision of these Terms & Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Terms & Conditions, which will otherwise remain in full force and effect.
